Terms of Use
1. Who we are and acceptance
These Terms govern your use of the mobile game Poker With Your Friends (the “Game”), published by Hadrien De Ryck, sole proprietorship (SIREN 940 152 374), trading as TestinGames, 6 rue des Tastes, 33460 Soussans, France (“we”, “us”). By downloading or playing the Game you accept these Terms and our Privacy Policy. If you do not accept them, please do not use the Game.
2. Who can play
You must be at least 18 years old to use the Game. The Game contains simulated card gambling and is not suitable for children or minors.
3. Virtual tokens, no real-money gambling
- The Game is played with virtual tokens only. They have no monetary value, cannot be bought with real money, sold, exchanged, transferred outside the Game or redeemed for money, goods or prizes.
- Winning tokens in the Game does not give you any real-world reward, and the Game is not a real-money gambling service.
- We may grant tokens (starting balance, weekly bonus, rewards for watching ads), and we may adjust, limit or reset balances, for example to fix an error, prevent abuse or rebalance the Game.
- Leaving a game early or going “deal out” may cause a temporary penalty or waiting period, as shown in the Game.
4. Your account
The Game creates an anonymous account for you automatically. You may link it to your Apple account (iPhone) or to your Google account (Android) to recover it on another device. You are responsible for what happens under your account. You can delete your account and its data at any time in Options > Delete account; this is permanent and your tokens and progress cannot be restored.
5. Playing with others
You play with friends in private lobbies using a lobby code. The person who creates a lobby is the host; the game runs from the host’s device, so the game ends for everyone if the host leaves. When you are disconnected, the Game tries to bring you back to your seat for a limited time; after that your seat is released.
6. Acceptable use
You agree not to:
- use a nickname that is offensive, hateful, sexual, impersonates someone, or contains personal information; nicknames are checked automatically and we may refuse or change them;
- harass, threaten or discriminate against other players;
- cheat, collude with other players to gain an unfair advantage, use bots, exploit bugs, or tamper with the Game, its servers or other players’ devices;
- reverse engineer, copy, modify or redistribute the Game, except as the law allows;
- use the Game for any unlawful purpose.
If you break these rules we may warn you, restrict features, reset your tokens, or suspend or delete your account.
7. Advertising
The Game is free and shows ads, including optional rewarded videos that can grant tokens. Ads are provided by third parties; we are not responsible for their content or for the products they advertise. How ads use your data is explained in the Privacy Policy.
8. Our rights and third-party components
The Game, its design, code, music and sounds belong to us or our licensors and are protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Game on your devices for your own non-commercial use. The Game uses third-party software and services (such as Unity) under their own licences.
9. Availability and changes
The Game depends on an internet connection and on third-party services. We try to keep it available and bug-free, but we do not promise uninterrupted service. We may change, suspend or stop the Game or any feature, and update these Terms. We will tell you about significant changes in the Game or by updating the effective date above; continuing to play after a change means you accept it.
10. Warranty and liability
The Game is provided “as is”, without any guarantee beyond those that the law does not allow us to exclude. To the maximum extent permitted by law, we are not liable for indirect losses, for the loss of virtual tokens or progress, or for interruptions caused by events beyond our control. Nothing in these Terms limits liability that cannot be limited by law, or the mandatory rights you have as a consumer.
11. Apple and Google
These Terms are between you and TestinGames only. Apple Inc. and Google LLC are not responsible for the Game, its content, maintenance or support, and are not a party to these Terms, although they may enforce them as third-party beneficiaries where the rules of their store say so.
12. Governing law and disputes
These Terms are governed by French law. If you are a consumer, you keep the benefit of the mandatory consumer-protection rules of the country where you live, and you may bring a dispute before the courts that have jurisdiction under those rules. We encourage you to contact us first so we can try to solve the problem.
